Auckland Council (“Council”) has issued an update to submitters on Plan Change 120 (“PC120”), following recent Government amendments to the Resource Management (Auckland Housing) Amendment Act earlier this year. The legislative changes reduce the minimum housing capacity that Auckland Council is required to enable through PC120, from 2 million to 1.4 million.

In response, the Council is currently considering whether amendments to the plan change should be proposed, in the form of reconfiguring where (and how much) intensification is to be enabled across Auckland. If amendments are proposed, Auckland Council will publicly notify the amended version of PC120 and open a new round of submissions. Submitters will then have the opportunity to lodge a second submission if they wish to provide additional comments or address any proposed changes.

Importantly, all original submissions already lodged on PC120 remain valid and will still be considered by the Independent Hearings Panel, regardless of whether a second submission is made. This process replaces the usual “further submissions” process, where parties may support or oppose another submitter’s position.

Auckland Council has also confirmed that the Summary of Decisions Requested is now publicly available. This document summarises the relief sought by submitters and can be viewed on the Council’s PC120 webpage here.
